Please read these Terms carefully. By signing up for our newsletter, you’re agreeing to these Terms.

These terms apply only to the free version of the Stitch Alongs. For the Terms and Conditions of The Pattern Club please visit www.thepatternclub.com.

Service

Stitchonomy Stitch Alongs are free, mail based events that consist of a certain amount of e-mails sent to the e-mail you subscribed with over a defined period of time. Sign ups must be made before the stated deadline via the sign-up form.

Account Eligibility

In order to use the Service you must:

  1. successfully complete the Stitch Along registration process before the stated deadline;
  2. agree to these Terms;
  3. provide true, complete, and up-to-date contact information;

Buying the kit does not guarantee the receipt of the patterns. It is your responsibility to sign up for the Stitch Along via www.stitch-along.com before the designated deadline. After this deadline has passed we will do everything in our power to add you to the automation but we cannot guarantee the receipt of the patterns without delay.

By using the Service you represent and warrant that you meet all the requirements listed above, and that you won’t use the content of the newsletters in a way that violates any laws or regulations. Note that by representing and warranting, you are making a legally enforceable promise.

You or Stitchonomy may terminate your participation at any time and for any reason by removing you from the list. We may suspend the Service to you at any time, with or without cause. If we terminate your subscription without cause, and you signed up via www.thepatternclub.com and paid for a Monthly Plan, we’ll refund a prorated portion of your monthly prepayment for a Monthly Plan. We won’t refund or reimburse you in any other situation, including if your account is suspended or terminated for cause, such as for a breach or violation of the Agreement.

Changes

We may change any of the Terms by posting revised Terms on our Site. Unless you terminate your account, the new Terms will be effective immediately upon posting and apply to any continued or new use of the Service. We may change the Service, Add-ons, or any features of the Service at any time, and we may discontinue the Service, Add-ons, or any features of the Service at any time.

Hard & Soft bounces

A hard bounce indicates a permanent reason an email cannot be delivered. In most cases, bounced email addresses are cleaned from our list automatically and immediately. Cleaned addresses will be excluded from all future campaign sends. Here are some common reasons an email may hard bounce.

  • Your email address doesn’t exist.
  • Your email server has completely blocked delivery.

Soft bounces typically indicate a temporary delivery issue and are handled differently than hard bounces. Soft bounces do not automatically exclude you from participating in Stitchonomy Stitch Alongs. If an email address continues to soft bounce in additional campaigns, the address will eventually be considered a hard bounce and cleaned from our audience. While there are many reasons an email address may soft bounce, these are some common reasons this could happen.

  • Mailbox is full (over quota).
  • Mailbox is not configured correctly.
  • Mailbox is inactive.
  • Recipient email server is down or offline.
  • Recipient email server has been sent too many emails during a period of time.
  • Email message is too large.
  • Domain name does not exist.
  • Email message blocked due to content.
  • Email message does not meet the recipient server’s policies.
  • Email message does not meet the recipient server’s DMARC requirements for authentication.
  • Email message does not meet the recipient server’s anti-spam requirements.
  • Email message does not meet the recipient server’s anti-virus requirements.
  • Email message does not meet the recipient server’s sender requirements.
  • Email cannot be relayed between email servers.
  • Email cannot be relayed for unknown reasons.

Stitchonomy cannot predict whether or not an email will bounce. Different internet service providers (ISPs) bounce email messages based on their own rating systems and definitions. 

Hard and Soft Bounces are problems are caused by your mail programme and cannot be solved by us. Please seek support from your mail client when having issues receiving our e-mails!

Copyright

We own all proprietary rights in the Service, including, but not limited to, patents, trademarks, service marks, trade secrets, copyrights, and other intellectual property rights. You will respect our proprietary rights in the Service, and you may only use our patterns for personal use.

Rules and Abuse

The following will automatically exclude you from participating in Stitchonomy Stitch Alongs:

  • Unsubscribing, before or during the SAL. If you unsubscribe after the end of a SAL and want to resubscribe for a new SAL you must resubscribe via www.stitch-along.com, in compliance with GDPR we cannot manually add you to our newsletter.
  • A Threat of Physical Harm. This means any statement, photograph, advertisement, or other Content that in our sole judgment could be reasonably perceived to threaten, advocate, or incite physical harm to or violence against others.
  • Hateful Content. This means any statement, image, photograph, advertisement, or other Content that in our sole judgment could be reasonably perceived to harm, threaten, promote the harassment of, promote the intimidation of, promote the abuse of, or promote discrimination against others based solely on race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, disease, or immigration status.

We also may suspend or terminate your account if we determine, in our sole discretion, that you are either:

  • an organization that has publicly stated or acknowledged that its goals, objectives, positions, or founding tenets include statements or principles that could be reasonably perceived to advocate, encourage, or sponsor Hateful Content or A Threat of Physical Harm;
  • a person that has publicly made a comment or statement, or otherwise publicly made known a position, including by membership in an organization as discussed above, that could be reasonably perceived as Hateful Content or A Threat of Physical Harm; or
  • a person or organization that has acted in such a way as could be reasonably perceived to support, condone, encourage, or represent Hateful Content or A Threat of Physical Harm.

Engaging in any of these actions or any breach of these stated rules will also result in a temporary or permanent ban from participation in any of the events, groups or pages hosted by Stitchonomy on all platforms and in-person.

Sharing

While I encourage you to share images of your finished work it is expressly forbidden to forward or share in any way shape or form the e-mails and its content including patterns. Engaging in the unlawful sharing of my copyrighted material may result in a temporary or permanent ban from participation in any of the events, groups or pages hosted by Stitchonomy on all platforms and in-person.

Limitation of Liability

To the maximum extent permitted by law, you acknowledge and agree that (i) you assume full responsibility for any loss that results from your use of the Service, including any downloads from the Newsletter; (ii) we and our Team won’t be liable for any indirect, punitive, special, or consequential damages under any circumstances, even if they’re based on negligence or we’ve been advised of the possibility of those damages; and (iii) in any calendar month, our total liability to you arising under or in connection with the Agreement—whether in contract, tort (including negligence), breach of statutory duty, or otherwise—will be no more than what you paid us for the Service the preceding month.

For the avoidance of doubt, in no instance will we or our Team be liable for any losses or damages you suffer if you use the Service in violation of these Terms, regardless of whether we terminate or suspend your account due to such violation.

No Warranties

To the maximum extent permitted by law, we provide the Service as-is. This means that, except as expressly stated in these Terms, we don’t provide warranties, conditions, or undertakings of any kind in relation to the Service, either express or implied. This includes, but isn’t limited to, warranties of merchantability and fitness for a particular purpose, which are, to the fullest extent permitted by law, excluded from the Agreement. Since Members use the Service for a variety of reasons, we can’t guarantee that it’ll meet your specific needs.
